Apple Seeks Additional Damages; Samsung Wants a New Trial

Apple and Samsung have headed back into the courtroom in the U.S. following the recent ruling that saw the former win a $1 billion decision.

After last month?s trial that saw Apple win $1 billion in damages from Samsung for patent infringements, it was known the two companies would have to head back into the courtroom this week for preliminary injunction hearings. Both legal teams also took the?opportunity?to file some new motions while they had Judge Lucy Koh?s attention.

For its part, Apple filed for an additional $707 million in damages. The iPhone makes was requesting $400 million in design infringements, $135 million for willful infringement, $121 million in product sales damage that were not covered by the jury and $50 million for prejudgement interest.

On the other side of the courtroom, Samsung filed for an entirely new trial. ?The Court?s constraints on trial time, witnesses and exhibits were unprecedented for a patent case of this complexity and magnitude, and prevented Samsung from presenting a full and fair case in response to Apple?s many claims,? Samsung said in its filing. ?Samsung therefore respectfully requests that the Court grant a new trial enabling adequate time and even-handed treatment of the parties.?

Samsung also took the?opportunity?to discuss the overall silliness of the patent system. ?It is unfortunate that patent law can be manipulated to give one company a monopoly over rectangles with rounded corners, or technology that is being improved every day by Samsung and other companies.? Of course, this also comes as Samsung has announced its intent to sue over certain aspects of the iPhone 5.

No word as of yet to when either company?s filing will be?ruled?upon, but it looks like this entire mess is far from over.
